Terms of Service

Article 1 — Definitions

In these terms of service, the following definitions apply: "WillieChat": the SaaS service offered by TheShopBuilders, located in Rijssen, the Netherlands. "Customer": any natural or legal person who creates an account and/or subscribes. "Service": the WillieChat platform including the AI chatbot, live chat, website scanner, and all related functionalities.

Article 2 — Applicability

These terms apply to every use of the service and to every agreement between WillieChat and the customer. By using the service or creating an account, the customer accepts these terms.

Article 3 — Accounts and registration

The customer is responsible for keeping login credentials confidential. Any use through the customer's account is deemed to have been performed by or on behalf of the customer. In case of suspected unauthorized use, the customer must notify WillieChat immediately.

Article 4 — Subscriptions and payment

WillieChat offers various subscription plans, including a free plan. Paid subscriptions are billed monthly or yearly via Mollie. The customer may cancel their subscription at any time. After cancellation, the service remains available until the end of the billing period.

Article 5 — Availability

WillieChat aims for 99.9% availability but cannot guarantee it. Planned maintenance will be announced in advance. WillieChat is not liable for damages resulting from temporary unavailability.

Article 6 — Intellectual property

All intellectual property rights to the service, software, and documentation belong to TheShopBuilders. The customer retains all rights to uploaded content. WillieChat uses this content exclusively for delivering the service.

Article 7 — Liability

WillieChat is not liable for indirect damages, consequential damages, lost profits, or missed savings. Total liability is limited to the amount the customer has paid to WillieChat in the past 12 months. AI-generated answers may contain inaccuracies; the customer remains responsible for content communicated through the chatbot.

Article 8 — Termination

Either party may terminate the agreement with respect to the current billing period. In case of serious breach of these terms, WillieChat may immediately suspend or terminate the account.

Article 9 — Changes

WillieChat reserves the right to modify these terms. Material changes will be announced at least 30 days in advance by email. Continued use after the change date constitutes acceptance.

Article 10 — Applicable law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the district of Overijssel, the Netherlands.
